Mega Edition: Bryan Kohberger And the Full Court Push For Dismissal (8/24/26)


Bryan Kohberger’s defense spent much of the pretrial period trying to dismantle the indictment by arguing that the grand jury process was legally defective and that the evidence presented to jurors was not sufficient to support the charges. His attorneys filed multiple motions attacking different aspects of the indictment, including claims that the grand jury had been improperly instructed on the standard of proof, that prosecutors had relied on inadmissible or misleading evidence, that exculpatory information had not been adequately presented, and that there were problems with the way the grand jury itself had been selected. At one point, the defense said it had identified roughly two dozen separate flaws in the indictment process. Kohberger’s lawyers also argued that the grand jury should have been required to find probable cause under a more demanding standard than prosecutors had used, and they sought access to extensive grand jury materials in an effort to support those challenges.

Prosecutors rejected those arguments and maintained that the indictment had been properly obtained, that the grand jury had been correctly instructed, and that the defense was attempting to impose requirements that Idaho law did not recognize. The state emphasized that a grand jury proceeding was not a trial and that prosecutors were not required to present every piece of potentially favorable evidence or prove guilt beyond a reasonable doubt before obtaining an indictment. Judge John Judge ultimately denied Kohberger’s major motions to dismiss, finding that the defense had not demonstrated misconduct, a substantial violation of the jury-selection process, or any other defect serious enough to invalidate the charges. The rulings left the indictment intact and forced the defense to shift its focus away from trying to eliminate the case entirely and toward challenging the state’s evidence, expert testimony, DNA analysis, cellphone records and other components of the prosecution’s case as trial approached.
