What Lindsay Clancy's Defense Filed That Could Prevent a Second Trial


Kevin Reddington filed a Rule 25(b)(2) motion on September 10 asking Judge Sullivan to enter a finding of Not Guilty by Reason of Lack of Criminal Responsibility on all charges against Lindsay Clancy. The hearing is scheduled for September 29 — the same date DA Tim Cruz is expected to indicate whether the state retries. The timing appears deliberate: Reddington is forcing the prosecution to respond to his motion before a second trial gains momentum.

Defense attorney Bob Motta joins the show to break down the legal architecture of the filing. Reddington concedes in the motion that a hung jury doesn't ordinarily terminate jeopardy. His argument is narrower: that the holdout juror's reported admission of reasonable doubt, combined with his alleged refusal to apply the court's instructions, means the mistrial was not a "manifest necessity." If Sullivan finds merit in that argument, double jeopardy attaches and the prosecution loses the right to retry.

Motta also dissects the prosecution's credibility problem. The Commonwealth's trial theory — that Lindsay staged her suicide attempt while simultaneously arguing she killed because she wanted to die — was reportedly rejected by 11 of 12 jurors. Going back with the same theory risks the same result. Going back with a new one invites the defense to ask why the state changed its story.

The plea deal dynamics are equally complicated. Reddington told ABC's "Good Morning America" he hoped Cruz would "revisit" the case, then told CNN he won't agree to any deal involving incarceration. The Plymouth County DA's office rarely negotiates. Motta examines what falls between those two positions — including the bench trial option on reduced charges that Reddington has said he'd consider for second-degree murder but not for first.
