When Women's Health Becomes a Legal Question

When Women's Health Becomes a Legal Question

Kate Cox learned that her fetus had trisomy 18 and sought an abortion after experiencing serious pregnancy complications. Amanda Zurawski's water broke at 18 weeks, but she testified that physicians waited until she developed life-threatening sepsis before intervening. Their cases eventually became part of the litigation over Texas's medical exceptions. The Texas Supreme Court ultimately held that the state's law permits abortion when, in a physician's reasonable medical judgment, a life-threatening condition creates the requisite risk - but rejected the broader injunction sought by the plaintiffs.

The question becomes bigger than "Is abortion legal?"

What happens when doctors believe they may have to defend an emergency medical decision to prosecutors afterward?
