Lindsay Clancy’s Lawyer Says WHAT About Her Alleged Confession?!

Kevin Reddington’s Rule 25 motion in the Lindsay Clancy case now attacks something more basic than criminal responsibility: whether the Commonwealth proved she committed the killings at all.

At the September 29 hearing in Plymouth Superior Court, Clancy’s defense attorney laid out what he described as a two-part argument for a required finding of not guilty. Reddington returned to his earlier request for a bifurcated trial, which would have separated the question of whether Clancy committed the charged acts from whether she was criminally responsible because of mental disease or defect. He argued that structure would have allowed the defense to contest the Commonwealth’s proof without forcing Clancy to incriminate herself while also presenting an insanity defense.

Reddington then went after the investigation itself. He challenged what he characterized as inconsistencies and investigative failures surrounding the deaths of Cora, 5, Dawson, 3, and Callan, 7 months, and Lindsay Clancy’s alleged attempt to harm herself on January 24, 2023. Most strikingly, he argued that Clancy’s alleged confession should not be treated as reliable proof, claiming it was a planted memory rather than an independent recollection.

Then came the second half of the Rule 25 argument. Even if the court finds sufficient evidence that Clancy committed the acts, Reddington argued the Commonwealth still failed to prove beyond a reasonable doubt that she was criminally responsible. His position is that prosecutors did not establish that Clancy was not experiencing psychosis when the children died.

Clancy has pleaded not guilty to three counts of murder and three counts of strangulation. Her first trial ended in a mistrial after the jury could not reach a unanimous verdict. Rule 25 now puts a different question before Judge William Sullivan: whether the evidence was legally sufficient to permit the case to continue.
