Social Media, Lawsuits And The Murders in Moscow

The article focused on the wave of online speculation that exploded during the early stages of the University of Idaho murder investigation, when police had not yet identified a suspect and social media users began publicly accusing friends, ex-boyfriends, roommates and other people connected to the victims. Attorney Matthew Bergman told Fox News that people who falsely identify innocent individuals as murder suspects could expose themselves to defamation lawsuits, especially when they use real names, photographs and specific accusations that spread widely online. He explained that the social media platforms themselves were generally protected by Section 230 of the Communications Decency Act, but the individual users making defamatory claims could still face legal consequences. Moscow police were already trying to contain the problem through “rumor control” updates and had warned that threats and harassment, including online harassment, could potentially result in criminal charges.

The broader concern was that amateur sleuthing was not simply creating bad information, but potentially damaging innocent people and interfering with the investigation. Bergman said false accusations can follow a person permanently once they go viral, and pointed to the Richard Jewell case as an example of the damage caused when someone is wrongly associated with a major crime. He said people targeted by these accusations could send cease-and-desist letters, demand retractions and potentially pursue lawsuits against those responsible. His message to internet investigators was essentially that they were not law enforcement and should stop publicly naming people based on speculation, because doing so could compound the trauma surrounding the murders while also creating serious legal exposure for the people spreading the accusations.
