Delphi Murder Case Attorneys Seek Clarification on Contempt Allegations

The legal proceedings surrounding the Delphi murder case have taken a new turn as attorneys for suspect Richard Allen seek clarity on contempt of court allegations brought against them by Carroll County Prosecutor Nicholas McLeland.

McLeland filed a motion last month, accusing attorneys Brad Rozzi and Andrew Baldwin of contempt of court, citing actions outside the courtroom that he deemed "indirect contempt of court." The allegations stem from Rozzi and Baldwin's conduct related to the high-profile case involving the abduction and murder of teenagers Libby German and Abby Williams in 2017.

Scheduled for a hearing on March 18 in front of Special Judge Frances Gull, the allegations have prompted Rozzi's and Baldwin's legal counsel, represented by attorney David Hennessy, to petition for further clarification on the nature of the contempt charges.

Hennessy's petition highlights the lack of specificity in McLeland's motion, particularly regarding what actions were deemed contemptuous. For instance, McLeland referenced a news release issued by Rozzi and Baldwin in November 2022, prior to the imposition of a gag order, without specifying its contemptuous nature.

"It seems clear that the State is really attempting to charge indirect criminal contempt," Hennessy stated in the petition, suggesting the possibility of separate criminal contempt proceedings. According to state guidelines, criminal contempt may carry penalties of imprisonment and fines, necessitating a distinct legal process initiated by the state.

As of now, McLeland has not initiated separate criminal contempt proceedings, leaving the status of the allegations uncertain. Hennessy's petition also seeks guidance on the nature of the upcoming hearing, questioning whether it will solely involve an advisement of specific allegations or include testimony and evidence presentation.

Special Judge Frances Gull, overseeing Allen's murder case, has yet to respond to the petition, leaving both the defense and prosecution awaiting further clarification on the contempt allegations.

With the trial of Richard Allen slated for October, the resolution of the contempt issue adds another layer of complexity to an already intricate legal saga, underscoring the importance of procedural clarity and fair adjudication in high-profile cases. As the legal process unfolds, stakeholders await the judge's decision on how to proceed with the contempt allegations, which could have significant implications for the defense and prosecution in the Delphi murder case.

Attorneys for Richard Allen, convicted of the 2017 murders of Liberty German and Abigail Williams in Delphi, Indiana, have filed a Motion to Correct Errors. The motion highlights four alleged legal missteps that they argue are significant enough to overturn the jury’s verdict or warrant a new hearing. Allen was convicted in November 2023 and sentenced the following month to 130 years in prison for the February 13, 2017, murders of the two teenage girls. The case has drawn nationwide attention for its complexity and lengthy investigation. The motion, filed by defense attorneys Andrew Baldwin, Jennifer Auger, and Bradley Rozzi, represents the first formal step toward appealing Allen’s conviction. The defense challenges the state’s claims that environmental factors, such as water or dirt, could have caused data suggesting headphones were plugged into the phone at the crime scene. “Ms. Eldridge’s opinion that dirt or water could not have caused L.G.’s phone to log wired headphones being plugged into and being unplugged from the phone on February 13, 2017, exculpates Mr. Allen and would probably produce a different result at a new trial,” the motion argues. The defense seeks either a dismissal of Allen’s convictions or a hearing to address the errors detailed in the motion. This filing is separate from the formal appeal anticipated to be submitted by newly-appointed appellate attorneys for Allen.
