Does Bryan Kohberger Actually Believe He's Innocent?

He answered yes when a judge asked if he was guilty. Now Bryan Kohberger says he was talked into it.

About a year after his sentencing on four consecutive life terms, Kohberger filed a handwritten petition for post-conviction relief in Ada County District Court, representing himself. He says his confession was false and that his actual innocence is his truth.

Tony Brueski and Robin Dreeke, who led the FBI's Counterintelligence Behavioral Analysis Program, work through what the filing actually argues and what the wording of it reveals.

The petition rests on ineffective assistance of counsel. Kohberger alleges his defense team did not disclose or review evidence that would have helped him. He alleges he was given a distorted account of what a life sentence and death row in Idaho involve. He points to threats and false promises as the reason he pleaded at all.

The discussion covers the practical question underneath all of it. He waived his appeal rights in the agreement, but a waiver has never stopped a defendant from attacking the validity of the plea itself. That is the opening he is using, and it was always there.

It also covers his statement that he would welcome prosecutors seeking the death penalty again, and what the Goncalves family said in response. They wanted a capital trial from the beginning and have said he simply wants another roll of the dice. Dreeke weighs whether that read holds up behaviorally.

Kaylee Goncalves, Madison Mogen, Xana Kernodle and Ethan Chapin were killed in November 2022. There was no trial and no motive on the record. Prosecutors could have required him to explain himself as a condition of the deal, and they decided not to. That silence is now part of what the families are living with.
