Mega Edition: Judge John Judge And The Denial Of Kohberger's Motion to Dismiss (8/15/26)

Judge John Judge denied Bryan Kohberger’s motion to dismiss the grand jury indictment that charged him with four counts of first-degree murder and one count of burglary in the November 2022 killings of Kaylee Goncalves, Madison Mogen, Xana Kernodle and Ethan Chapin. Kohberger’s defense had argued that the indictment should be thrown out because prosecutors had presented insufficient evidence to establish probable cause and because the grand jury had allegedly been given improper or misleading instructions about the legal standard it was supposed to apply. The defense also challenged the manner in which evidence had been presented during the secret grand jury proceedings, contending that irregularities in the process undermined the validity of the indictment. Judge rejected those arguments, finding that prosecutors had presented sufficient evidence for the grand jury to determine that probable cause existed and that the proceedings did not contain errors serious enough to justify dismissing the charges.

Judge also rejected the defense’s contention that Idaho law required prosecutors to establish a higher standard of proof before an indictment could be returned. Kohberger’s attorneys had argued that the grand jury should have been instructed under a standard closer to the one necessary to establish that a defendant was more likely than not guilty, rather than simply determining whether probable cause existed. Judge concluded that Idaho precedent did not support the defense’s interpretation and that the grand jury had been properly instructed under the applicable law. The ruling represented an important defeat for Kohberger’s defense because it preserved the indictment and allowed the prosecution to continue toward trial without having to return to a preliminary hearing or seek a new indictment. Judge’s decision also reinforced that challenges to the ultimate strength of the prosecution’s evidence were matters to be resolved at trial rather than grounds for eliminating the case at the indictment stage.
