Mega Edition: Judge Hippler Removes The Gag Order From Kohberger Case (8/29/26)

Judge Steven Hippler lifted the gag order in the Bryan Kohberger case after Kohberger pleaded guilty and was sentenced, concluding that the circumstances that originally justified the sweeping restrictions on public statements had fundamentally changed. The order had been imposed during the pretrial phase to protect Kohberger’s right to a fair trial and reduce the risk that lawyers, investigators, law enforcement officers, witnesses and others connected to the case could influence the jury pool through public commentary. Once there was no longer going to be a trial, Hippler found that the strongest constitutional justification for keeping those restrictions in place had largely disappeared. His ruling therefore removed the broad limits that had governed public discussion of the case for years and allowed attorneys, investigators and others previously bound by the order to speak publicly again, subject to the ordinary ethical and legal rules that still applied.

The decision marked the end of one of the most contentious transparency battles in the Kohberger case. News organizations, victims’ families and other interested parties had repeatedly challenged the gag order or argued that it restricted too much information from reaching the public, while the defense had consistently emphasized the need to protect Kohberger from prejudicial publicity. Hippler’s order reflected the reality that those competing concerns looked very different after a guilty plea eliminated the need to seat an impartial jury. Lifting the gag order did not automatically unseal every document or make every piece of evidence public, because separate sealing orders and privacy protections could still remain in effect, but it removed the extraordinary speech restrictions that had surrounded the prosecution since its earliest stages. In practical terms, the ruling opened the door for many of the people directly involved in the case to finally discuss their experiences and the investigation without violating the court’s pretrial publicity order.
