The Instruction Lindsay Clancy’s Jury Was Never Meant to Understand

The criminal responsibility instruction in Lindsay Clancy’s trial asks a jury to navigate double negatives, undefined legal terms, and a burden of proof that runs backwards from what most people expect. The prosecution has to prove she was sane — not the defense proving she wasn’t. Fewer than one in three jurors understand the reasonable doubt standard in comprehension studies. Massachusetts has a plain-language drafting guide. They didn’t apply it to this charge.

On top of that, the jury was handed two commands that cancel each other. Follow the law whether you agree with it or not. Your verdict must be the result of your own convictions. The foreperson described signing all three verdict forms before the holdout reversed himself. Another juror defended the holdout in words that echo the instruction itself. The holdout has not spoken.

When the defense pushed the judge to re-read the reasonable doubt standard with force, his response from the bench lays bare a system where checking the box is the job — and whether anyone can use the instructions is someone else’s problem. The highest court in the state has admitted the deadlock charge “has a sting.” They still use it.

DA Cruz has not said whether he’ll retry. Hearing is September 29th.
