Caleb Flynn Trial Day 1: K9 Hayes Tracked WHAT at Garage?

The search for evidence of a suspected intruder moved outside the Flynn home as jurors heard from a police K9 handler and an FBI agent. One searched for a scent trail. The other searched the neighborhood for someone who had seen or recorded a possible burglar.

David Laycox, a deputy and K9 handler with the Preble County Sheriff’s Department, testified about working the scene with K9 Hayes, a police dog trained to track human scent.

Laycox said Hayes picked up a strong scent along the side of the garage. According to his testimony, the dog repeatedly tried to enter the garage because the scent appeared stronger there.

Hayes then performed a perimeter search around the property. Laycox testified that the dog did not detect a scent trail indicating someone had moved away from the scene. Hayes returned to the area of the stronger scent and again attempted to enter the home.

Laycox described that as a negative alert for a suspect leaving the scene.

Cross-examination added an important limitation. Laycox acknowledged that the K9 search did not eliminate the possibility that someone had left the house. A tracking dog failing to locate an outgoing trail is not the same thing as proving no one left.

FBI Agent Michael Tom testified about another search for that possible person. Tom, stationed in Dayton, said he canvassed the area, questioned neighbors and others nearby, and looked for doorbell-camera footage that might identify a suspected burglar.

Tom testified that nothing was reported from that canvass.

Those two searches matter because Caleb Flynn’s defense maintains that Ashley Flynn was killed during a home invasion. Prosecutors allege Caleb killed Ashley and staged the Tipp City home to resemble a burglary. Caleb has pleaded not guilty to all charges.

The state now has testimony about what investigators did and did not find outside the house. The defense has already established that an unsuccessful search does not prove an intruder could not have left.
