Lindsay Clancy Holdout Did WHAT With a Trial Exhibit?!

Lindsay Clancy jury room accounts now include a trial exhibit, a water bottle, a reasonable-doubt admission, and a deadlock that ended a six-week murder trial without a verdict. Jurors who have spoken publicly say eleven members ultimately favored a finding of not guilty by reason of lack of criminal responsibility and one member did not.

Nick Dargie, the first male juror to speak publicly, told ABC News that he repeatedly asked the holdout to show the evidence behind his position. Dargie says the juror could not point to a witness or exhibit that answered him and at times scrolled on his phone while other jurors were talking. Then came the moment Dargie says left him stunned: the holdout took an exercise band from the evidence bag, put it around an empty water bottle, and pulled.

Roni Carlson, the jury foreperson, says a separate exchange made her think the case was over. According to Carlson, the holdout said he had reasonable doubt. She began completing and signing the three verdict forms. Carlson says he then told the room he still would not vote for a not-guilty-by-reason-of-insanity verdict.

Judge William Sullivan had already received jury notes reporting a deadlock and a complaint that one member was not applying the reasonable-doubt instruction. Sullivan questioned the jurors, reviewed the law, and directed them to continue. Massachusetts' Tuey-Rodriguez instruction also tells deadlocked jurors not to surrender an honest conviction merely to reach a unanimous result. The panel never got there.
