Ghislaine Maxwell Attempts To Use The NPA To Overturn Her Sentence

Ghislaine Maxwell made Jeffrey Epstein’s 2007 non-prosecution agreement one of the central arguments in her appeal, contending that the deal should have barred federal prosecutors in New York from charging her at all. The agreement, negotiated by the U.S. Attorney’s Office in the Southern District of Florida, promised that the government would not prosecute Epstein’s “potential co-conspirators,” and Maxwell argued that the language was broad enough to protect her nationwide. Her lawyers said the federal government could not allow one U.S. Attorney’s Office to make that promise and then permit another office, years later, to prosecute someone who fell within the agreement’s protection. Maxwell therefore argued that her indictment should have been dismissed and her conviction vacated because the government had violated the terms of Epstein’s deal.

The Second Circuit rejected that argument and upheld Maxwell’s conviction and 20-year sentence. The appeals court concluded that Epstein’s agreement bound the Southern District of Florida, not the Southern District of New York, and therefore did not prevent Manhattan federal prosecutors from bringing the case against Maxwell. After losing in the Second Circuit, Maxwell carried the same issue to the U.S. Supreme Court, arguing that federal courts were divided over whether one U.S. Attorney’s Office can bind prosecutors elsewhere in the country. The NPA argument ultimately failed to undo her conviction, but it remained one of Maxwell’s most persistent legal theories because, if accepted, it would have attacked the government’s authority to prosecute her in the first place rather than merely challenging individual evidence or trial rulings.
