Richard Allen Was Forcibly Medicated After His Own Doctor Found This

Richard Allen's Delphi murders conviction is under review at the Indiana Court of Appeals, and the appeal hearing on September 21, 2026, opened with a psychiatrist, a cell floor, and a date: April 14, 2023.

Allen, convicted in November 2024 of killing Abby Williams and Libby German on the Monon High Bridge trail, was held before trial in a segregation unit at Westville Correctional Facility for thirteen months. His appeal lawyer, Mark Leeman, told the panel that on April 14 the prison's own psychiatrist found Allen incommunicado on the floor, covered in feces, and declared him gravely disabled. That order started a course of Haldol injections he did not consent to, and it recorded that his symptoms had started on April 4.

Leeman's point was about what the state did with that information. Allen's trial lawyers had filed an emergency motion nine days earlier asking to move him. Leeman says the state answered by calling the filing colorful and dramatic, and the trial judge denied it without the hearing he says the law required. That, he argued, is coercion without an interrogation: the state saw a man breaking and worked to keep him in the room where it was happening.

Deputy Attorney General Ellen Meilaender argued there was no coercive state action at all. Allen was in restrictive housing because he could not be safely housed with other inmates, she said, and the conditions were ordinary. He had out-of-cell recreation, showers, commissary, medical checks, medication, and a tablet the prison replaced for free when he broke it.

Defense attorney Bob Motta and I work through the three clips that frame this fight, including the state's position that only five of Allen's confessions fall inside his psychosis and the rest stand on their own.

The panel has the case under advisement. The decision, whenever it comes, can be appealed to the Indiana Supreme Court.
