Richard Allen's 13 Months Alone Was Called This by the State's Own Lawyer

Defense attorney Bob Motta and I sit down with the full Indiana Court of Appeals hearing on Richard Allen's Delphi murders conviction, argued September 21, 2026, and we play the clips that decide it.

The center of the appeal is a cell. Allen was moved to Westville Correctional Facility under a safekeeping order in November 2022 and spent thirteen months in a segregation unit before his trial. The confessions the jury heard, 61 by the state's count, all came from that unit in the spring of 2023.

Mark Leeman, arguing for Allen, told the judges the state took a pretrial detainee straight to the hole, watched him descend into psychosis, and used what he said there. Deputy Attorney General Ellen Meilaender told the same judges that Allen could not survive general population and that the unit's conditions were ordinary. A replacement tablet, a new window, and visits from his wife, she argued, show he was treated better than other inmates.

We also cover the two fights that could matter as much as the confessions. The first is Brad Holder, a man state police investigated in 2017 and never charged. The defense says his hand tattoo and social media posts point to a ritual staging of the scene; the state says he was at work 25 miles away. The second is what's left without any confession at all: an unfired cartridge, an excluded eyewitness sketch, and Allen's own 2017 statement to a conservation officer that he was on the trail.

Bob takes each rule apart in plain English: voluntariness and who has to prove it, the direct-connection test for another suspect, and harmless error.

Richard Allen is serving 130 years for the murders of Abby Williams and Libby German. Three judges are deciding whether he gets a new trial.
