EU AI Act Ushers in New Era of Responsible AI Governance

This groundbreaking legislation, approved by the European Parliament with a sweeping majority, is set to revolutionize the way we think about artificial intelligence.

Starting February 2, 2025, the EU AI Act will ban AI systems that pose an unacceptable risk to people's safety, or those that are intrusive or discriminatory. This includes AI systems that deploy subliminal, manipulative, or deceptive techniques, social scoring systems, and AI systems predicting criminal behavior based solely on profiling or personality traits. The intent is clear: to protect fundamental rights and prevent AI systems from causing significant societal harm.

But what does this mean for companies and developers? The EU AI Act categorizes AI systems into four different risk categories: unacceptable risk, high-risk, limited-risk, and low-risk. While unacceptable risk is prohibited, AI systems falling into other risk categories are subject to graded requirements. For instance, General Purpose AI (GPAI) models, like ChatGPT-4 and Gemini Ultra, will be subject to enhanced oversight due to their potential for significant societal impact.

Anna-Lena Kempf of Pinsent Masons notes that the EU AI Act comes with plenty of room for interpretation, and no case law has been handed down yet to provide steer. However, the Commission is tasked with providing more clarity by way of guidelines and Delegated Acts. In fact, the AI Office is obligated to develop and publish Codes of Practice on or before May 2, 2025.

As I ponder the implications of this legislation, I am reminded of the words of experts like Rauer, who emphasize the need for clarity and practical guidance. The EU AI Act is not just a regulatory framework; it is a call to action for companies and developers to rethink their approach to AI.

In the coming months, we will see the EU AI Act's rules on GPAI models and broader enforcement provisions take effect. Companies will need to ensure compliance, even if they are not directly developing the models. The stakes are high, and the consequences of non-compliance will be severe.

As I finish my coffee, I am left with a sense of excitement and trepidation. The EU AI Act is a pioneering framework that will shape AI governance well beyond EU borders. It is a reminder that the future of AI is not just about innovation, but also about responsibility and accountability.
