Inside Kenya's System: Allegations of Brutality and Disregard

Inside Kenya's System: Allegations of Brutality and Disregard

This podcast explores serious allegations concerning human rights violations and a disregard for the rule of law in Kenya, as highlighted by investigations such as the "Murder Tapes" series, which revisited the execution of four young men in Nakuru. During his time as Interior Cabinet Secretary, Fred Matiangi faced multiple allegations of human rights violations. These allegations reportedly stemmed from various incidents, including police brutality, suppression of civil liberties, and disregard for junior orders.

The podcast delves into reports of widespread police brutality during the enforcement of COVID-19 curfews, citing instances where police officers allegedly assaulted civilians, including entering homes and beating occupants. A notable case involved the killing of a 13-year-old minor by police during this period. Matiangi also stands accused of overseeing a regime marked by extrajudicial killings and unforced disappearances as interior cabinet secretary. Human rights organizations reportedly reported numerous cases of police killings and disappearances during this time.

Furthermore, the podcast examines instances where court orders were allegedly ignored. This includes the contempt of court case in early 2018 following the controversial deportation of opposition figure Miguna Miguna. The source notes that the High Court issued multiple orders directing Miguna be released and produced in court, which were ignored by Matiangi and other senior officials. Justice George Odunga found Matiangi, alongside the inspector general of police and immigration director, guilty of contempt of court and they were each fined. Despite a subsequent High Court order allowing Miguna entry into the country, Matiangi and other officials reportedly facilitated his forced deportation to Dubai. This act was seen as a blatant disregard of the rule of law. A case filed in 2021 also accused Matiangi and other officials of failing to comply with a court order to provide tender documents related to a 1 billion shilling project, prompting a request for their jailing for contempt.

The podcast explores the context surrounding these events, including Matiangi's secretariat stating that his position on human rights was taken out of context and that he is a great believer in human rights and the rule of law. It also notes that investigations by the Independent Policing Oversight Authority (IPOA) into the Nakuru incident have reportedly commenced. The calls for accountability for these alleged actions have been reignited, with figures like Nandi Senator Samson Gerard Gay highlighting incidents of disappearances.
