Judge Berman’s decision to unseal the Epstein grand jury documents represents one of the most forceful judicial pushes for transparency in a case that has been defined by secrecy, institutional hesitancy, and years of bureaucratic dodgeball. In his ruling, Berman made clear that the new federal Epstein transparency law leaves no ambiguity: Congress intended these records to be opened, and the courts are obligated to follow that mandate. He dismissed the government’s familiar attempts to stall—claims of “ongoing investigations,” potential harm, or procedural barriers—pointing out that federal authorities had ample time to act and repeatedly failed.
