Judge Marra’s Epstein Opinion and the CVRA Wall (Part 1) (12/15/25)

While recognizing the petitioners’ claims of exclusion and harm, the court held that it lacked authority under the statute to grant retrospective relief that would nullify the agreement, leaving the petitioners without a judicial remedy in that proceeding despite the acknowledged concerns about how the case was handled.
