The EU Artificial Intelligence Act also stipulates the establishment of a European Artificial Intelligence Board. This Board will facilitate the consistent application of the AI regulation across the member states, assisting both national authorities and the European Commission. Furthermore, the act introduces measures for market monitoring and surveillance to verify compliance with its provisions. Critiques of the Act emphasize the need for clear, actionable guidance on implementing these requirements to avoid inhibiting innovation with overly burdensome regulations. Advocates believe that a careful balance between regulatory oversight and fostering technological development is crucial for the EU to be a competitive leader in ethical AI development globally. In terms of enforcement, considerable penalties have been proposed for non-compliance. These include fines up to 6% of a company’s total worldwide annual turnover for the preceding financial year, which align with the stringent penalties imposed under the General Data Protection Regulation.
