AND...

Tracers

Gathering information is important for lawyers, especially lawyers who do litigation. As you no doubt know, law doesn't win cases, facts do, and often one or two key facts can make or break a case.

Key facts are tied to witnesses who sometimes are elusive. Key facts can involve things about your client that they conveniently "forget" to tell you.

And for sure key facts are incriminating things about the opposing party. Key facts can be in social media or any number of public databases. So how do you find the key facts quickly and easily?

Well, you can find them but not usually quickly and easily. Even the publicly available information is strewn about in lots of different public records or online locations that you can't find using one Google search.

So stop trying to use Google and don't waste time, energy, or money. Use Tracers instead. That's how you can get cost-effective access to asset records, social media posts, and detailed background information on anyone of interest to you or your client.

The cost is based on a "pay per search" pricing with a $39 monthly minimum. The searches aren't super expensive so you might only spend $39 per month and be able to do a few searches.

But however much you use it you can expense the cost to your client matter because it's an essential service.

I recommend that every lawyer at least sign up, learn what it can do, and get used to having an amazing resource at your fingertips. If you use the promo code Ernie100 the first $100 of your search will be free.

Episode 21: How to Improve Your Reputation

Episode 21: How to Improve Your Reputation

The public's perception is that most lawyers care more about making money than helping their clients. Instead of trying to argue against this, realize that: perception = truth. For prospective clients, their truth is all that matters. To help reorient their perceptions we need to first listen to their concerns. This is called "empathy," and most lawyers are not good at it. We tend to focus too much on proving that we're skilled, knowledgeable and zealous advocates. But the public cares more about whether we're sincerely motivated to help. Remember: no one cares how much you know until they know how much you care. To help develop your empathy, read Dale Carnegie's book How To Win Friends and Influence People. And if you already read it, read it again. Episode 20: Perhaps My Competitors Can Help Your Practice

Episode 20: Perhaps My Competitors Can Help Your Practice

Most lawyers are burned out juggling both the intense demands of a practicing law AND the administrative details in managing their business. Mostly, they want help streamlining their operations and getting better clients to come through their door in a predictably steady flow. I've created several programs that help attorneys improve their practices so they can work less, earn more, and spend more time relaxing away from the office. But, if my programs don't appeal to you, then check out some of my competitors such as... Lee Rosen - a divorce attorney who sold his practice and now runs the Rosen Institute. John Fisher - a personal injury attorney who also runs mastermind programs. Alexis Neely - an estate planning lawyer who worked at Munger Tolles and now coaches attorneys via online courses and other programs. RJon Robbins, the founder of How To Manage a Small Firm (a person that some people find suspiciously cagey and off-putting) Richard James - a non-lawyer marketing coach. Stephen Fairley - a psychologist who teaches lawyers how to better market their practices. Ben Glass - a personal injury attorney who also teaches legal marketing. Episode 19: Embrace Sensible Business Management, Not Artificial Intelligence

Episode 19: Embrace Sensible Business Management, Not Artificial Intelligence

Artificial intelligence and the rise of robot lawyers are interesting topics to talk about. But they're not helpful if you are looking for ways to improve your practice. Trying to "innovate" for the sake of innovation is dangerous at worst. And at best it's a waste of time. You should focus on the nuts and bolts of managing your practice better. Using systems is crucial. After you've created good systems, and documented them, then you can focus on automation and outsourcing. You need to manage your practice in a sensible, methodical way. When it comes to marketing, focus on your strength which is providing personal service to people that interact with you in a way that causes them to like you and trust you. Don't try to compete with commoditized legal services like Legal Zoom or Avvo. Be the down-to-earth, sincere caring lawyer that your clients want you to be. And, if you're going to use technology like a website to market your practice, then use it in a way that sends the right message to the kinds of people you want as clients. Learn how to find good clients who are thoughtful, discriminating and happy to pay a premium for your valuable services. Episode 18: Achieving Success Deliberately

Episode 18: Achieving Success Deliberately

The key to improving your law practice is to proceed deliberately. The tendency to rush is strong but must be suppressed. Technology initiatives are particularly challenging because of the complexity and rapid change inherent in digital tools. But all the more reason to be deliberate and patient. In all aspects of developing your law practice, you should seek constant, steady improvement—as opposed to rapid, sudden change, which is stressful and disruptive. The Japanese word "kaizen" captures this notion wonderfully When considering new opportunities it's best to be patient and work from a well-thought-out plan. And the more people that are involved in a new initiative the more patience and thoughtfulness is required. Episode 16: Creating Systems in a Law Firm

Episode 16: Creating Systems in a Law Firm

We talked generally about systems in episode 8. This episode goes deeper into the types of systems law firms use, and how to document systems. In law firms, there are two categories of systems: process systems and record-keeping systems. Processes are the most valuable law firm systems because that's how the work gets done. If you want a smooth-running firm, you have to document (i.e. "map") those processes systematically. And you do that by asking 5 key questions. Lawyers are pretty good at record keeping systems such as calendaring appointments and deadlines, contact records, matter-related documents etc. But you still need to pay close attention to how records information is managed.
