The Motion To Strike Death Penalty Against Kohberger On Grounds Of Speedy Trial (Part 1)

Bryan Kohberger’s defense team has filed multiple motions to strike the death penalty in his case, which involves the murders of four University of Idaho students in November 2022. Kohberger faces four counts of first-degree murder and one count of burglary. The prosecution, led by Latah County Prosecutor Bill Thompson, intends to seek the death penalty, citing several aggravating factors, including the "heinous" nature of the crime and Kohberger's "disregard for human life".

Kohberger’s attorneys argue that Idaho’s right to a speedy trial conflicts with their ability to effectively defend against the death penalty. They claim that insufficient time has been allocated for preparing a defense in such a complex and high-stakes case​. Additionally, the defense is challenging several of the aggravating factors used to justify the death penalty, arguing that they are unconstitutionally vague and do not offer clear guidelines for jurors to follow. One key argument is that the statute under which these aggravators fall does not meet constitutional standards.
