Bryan Kohberger's Case Rests On A Woman He Blames

Bryan Kohberger is trying to withdraw his guilty plea and win a new trial — and he seems not to have priced what winning would cost him.

He traded a trial for his life. The agreement he signed in the Idaho student murders took the death penalty off the table in exchange for four consecutive life sentences and a waiver of his right to appeal. Now he wants the agreement gone.

If a judge vacated that plea, the deal dissolves — and legal experts told Newsweek that Kohberger would be facing capital punishment all over again. One former federal prosecutor called the attempt foolish, and said that if this case were actually tried, there is a very good chance he is convicted and sentenced to death. Idaho's attorney general said his office stands ready to do whatever is necessary.

So the lawyer Kohberger is calling ineffective is the one who got the needle taken away, and saving his life is the failure he is alleging.

Tony lays out how he got here. A witness list filed by prosecutors weeks before trial. A name on it that changed the math. A guilty plea entered days later, under oath, with the judge asking him point blank whether he actually committed these crimes because he didn't want the man confessing to something he hadn't done.

And then, thirteen months later, five handwritten pages saying none of it was true.

The petition is not frivolous and there is a real statute behind it. But there is a difference between a door being open and a man being able to walk through it. This episode is about exactly where that line falls, and what four families are being asked to sit through while it plays out.
