Indiana's Lawyer Defended Richard Allen's Solitary Cell by Calling It This

For thirteen months before his trial, Richard Allen lived in a solitary cell at Westville Correctional Facility, and on September 21, 2026, the State of Indiana defended that cell at the Indiana Court of Appeals. How the state's lawyer characterized it is the thread through this complete breakdown with defense attorney Bob Motta.

Allen is serving 130 years for the 2017 Delphi murders of Abby Williams and Libby German. His appeal, argued by Mark Leeman, rests on three claims.

First, that the confessions he made in that cell came from a mind the state broke. Second, that the jury was blocked from hearing about another suspect and the sketch an eyewitness helped draw. Third, that the search warrant for his home rested on a false account of what witnesses said.

The state's answers came from Deputy Attorney General Ellen Meilaender. Restrictive housing is ordinary custody, she argued, and Allen was there for his own safety; only five of his confessions fall inside his psychosis. Brad Holder, investigated in 2017 and never charged, was clocked in at a landfill 25 miles away. And Allen's own 2017 statement placing himself on the trail supplied probable cause and remains the most powerful evidence against him, she said.

The judges took the case under advisement and will issue a written decision. The losing side can petition the Indiana Supreme Court.
