Episode 96: Danny Casolaro — Murdered for Getting Too Close to the Truth

On August 10th, 1991, the body of freelance journalist Danny Casolaro was found in the bathtub of Room 517 at the Sheraton Hotel in Martinsburg, West Virginia. His wrists had been slashed twelve times. The local medical examiner ruled it a suicide. His briefcase — containing the notes, documents, and source contacts for years of investigative work into what he called "the Octopus" — was gone. It was never found. Casolaro had told multiple people in the weeks before his death that he was close to finishing the story and that he had been warned to back off. He had also told his brother that if he died, not to believe it was an accident.

Danny Casolaro was investigating something that connected a software theft case, the BCCI banking scandal, the October Surprise conspiracy theory, the Inslaw software affair, Iran-Contra, and the CIA's operations in Afghanistan, Central America, and the Middle East, into a single unified network of criminal enterprise operating beneath and through the institutional structures of the American state. He called this network the Octopus. He believed he had found, in the Inslaw case — the story of a software company whose programme PROMIS had allegedly been stolen by the Department of Justice and sold to foreign intelligence services — the thread that pulled the entire tapestry together.

In this episode of The Conspiracy Theory Analyst, we examine the Danny Casolaro case — the documented substance of his investigation, the specific evidence that the Inslaw affair involved deliberate theft and distribution of intelligence software with surveillance capabilities built in, the suspicious circumstances of his death, and what his story tells us about what happens to journalists who get too close to the right questions.

The Inslaw affair is, by itself, thoroughly documented and deeply disturbing. The company Inslaw, founded by Bill Hamilton and his wife Nancy, developed a case-management software called PROMIS that was licensed to the US Department of Justice. Hamilton alleged that the DOJ used the software, refused to pay for it, drove the company into bankruptcy, and then distributed PROMIS — with modifications — to intelligence agencies and foreign governments. A federal bankruptcy judge and a federal district court judge both found that the DOJ had stolen the software and acted with "wilful and deceitful" conduct. The findings were overturned on jurisdictional grounds, not on their merits. Congressional investigations were opened. Witnesses died. The modified PROMIS that Casolaro was tracking — which some sources claimed had a secret backdoor allowing intelligence agencies to monitor any system using it — would, if the claims were accurate, represent one of the most extraordinary intelligence operations in modern history.
