Why Lindsay Clancy's Whiteboard Message Haunts This Case

After her children died, Lindsay Clancy was in a hospital bed with a tube down her throat. She could not speak. She was given an erasable whiteboard. The first thing she wrote on that whiteboard was a question. It is one of the most contested moments in this entire case.

Her jury is seated. Eighteen people in Plymouth Superior Court will have to decide whether a mother who was on thirteen psychiatric medications was criminally responsible when she killed her three children. Both sides stipulate that she did it. The fight is over whether she was sane.

The prosecution argues premeditation. She used Apple Maps to calculate how long her husband would be gone. She allegedly strangled all three children during that window and then attempted to take her own life by jumping from a second-story window.

The defense argues systemic failure. Thirteen medications in four months. Zoloft, Prozac, Klonopin, Seroquel, Valium, Ambien. Her husband Patrick told the doctors she had turned into a zombie. No one coordinated care.

Patrick Clancy is expected to testify first for the prosecution. He filed a malpractice suit against her doctors. He told a reporter he was not married to a monster. Under Massachusetts law, the prosecution must prove she was sane beyond a reasonable doubt.

Andrea Yates was convicted, then acquitted at retrial, under a Texas standard that required the defense to prove insanity. Massachusetts flips the burden. The prosecution has to prove Lindsay Clancy was sane beyond a reasonable doubt. That is a higher bar to clear, and the medical record is not going to make it easier.
