The U.S. District Court for the District of Columbia has approved the FBI's request to submit a confidential declaration regarding its reasons for withholding certain records related to a 1990s investigation involving Nigerian President Bola Tinubu.On August 21, 2026, Judge Beryl Howell sanctioned the agency’s motion to file its explanation ex parte and in camera (under seal) to protect sensitive information from becoming public. The court has established a firm deadline of August 28, 2026, for the FBI, the Drug Enforcement Administration (DEA), the Department of Justice (DOJ), and President Tinubu to submit their formal oppositions or justifications concerning the release of these documents.The ongoing legal dispute revolves around Freedom of Information Act (FOIA) requests made by American transparency advocate Aaron Greenspan, who is pursuing the complete FBI file and interview records of Tinubu from 1992 and 1993. In its motion, the FBI cited specific FOIA exemptions, highlighting two significant risks.Under Exemption 7(F), the agency indicated that public disclosure could reasonably be anticipated to endanger the life or physical safety of individuals, potentially including criminal informants. Additionally, this action may reveal Law Enforcement Techniques. Under Exemption 7(E), the FBI contended that a public explanation would disclose sensitive, non-public investigative methods and strategies.The records originate from a historical narcotics and money laundering investigation in Chicago during the early 1990s, which led to Tinubu forfeiting $460,000 to the U.S. government in 1993. Tinubu was never criminally charged and has consistently asserted that the issue was a civil settlement.In April 2025, Judge Howell rejected initial attempts by the FBI and DEA to completely hide the files under a "Glomar response" (refusing to confirm or deny the records existed), ruling that the defense was "neither logical nor plausible" and ordering the processing of non-exempt materials.The Nigerian Presidency has consistently rejected the legal proceedings, asserting that the reports reveal "nothing new" and do not implicate the leader. In contrast, Nigerian opposition figures, including former Vice President Atiku Abubakar, have engaged Washington lobbying firms to monitor the filings and actively call for the immediate public disclosure of the documents.The historical U.S. financial forfeiture case involving President Bola Tinubu cannot be accurately or factually equated with that of Pablo Escobar. Although critics and political adversaries occasionally employ the "Pablo Escobar" label in a rhetorical manner, the scale, nature, and documented facts of the two cases are fundamentally distinct.In contrast, Bola Tinubu has never faced criminal charges, indictments, or convictions for any drug-trafficking offenses in either the United States or Nigeria. His legal team and supporters have consistently argued that the long-standing civil matter does not equate to a criminal conviction.
