Murder In Moscow: The Order Releasing Property To Family Members Of the Victims

On March 24, 2023, Magistrate Judge Megan Marshall issued an order addressing how much of a stipulation concerning the release of property in the Bryan Kohberger case could be made public. The dispute followed the State’s request to temporarily seal the “Stipulation to Release Property” and related documents, and the court heard arguments from prosecutor Ashley Jennings and Kohberger’s attorney Anne Taylor. After weighing the public’s interest in access against privacy, safety and fair-trial concerns, Marshall found that portions of the records needed protection because they contained highly intimate information, material that could potentially endanger individuals, information that could invade personal privacy and details that could reveal investigative techniques or procedures. The court also concluded that unrestricted disclosure could jeopardize Kohberger’s right to a fair trial.

Marshall ultimately chose partial secrecy rather than sealing everything connected to the matter. Exhibits A and B attached to the Stipulation to Release Property were ordered completely sealed, while the stipulation itself and the corresponding Order to Release Property were permitted to become public only after certain information was redacted. The restrictions were ordered to remain in place until the court directed otherwise. The ruling was representative of the intense secrecy that surrounded the Kohberger investigation during its early stages, when the court repeatedly had to balance extraordinary public interest in the case against concerns that releasing investigative details, private information or sensitive evidence too early could compromise individuals involved or prejudice the eventual prosecution.
