Delphi Appeal: Three Judges Heard the State Call Richard Allen's Cell This

The full Delphi murders appeal hearing, argued September 21, 2026, in the Supreme Court courtroom at the Indiana Statehouse, broken down clip by clip with defense attorney Bob Motta. Judges Nancy Vaidik, Elaine Brown, and Robert Altice gave each side 30 minutes and then some. What the state's lawyer called Richard Allen's thirteen months at Westville is the line that frames everything else.

Mark Leeman opened for Allen by calling the proceedings unprecedented, unfair, and unconstitutional: a pretrial detainee taken straight to the hole, kept there as he lost his mind, and convicted on what he said there. Deputy Attorney General Ellen Meilaender answered that the conditions were ordinary, the placement was for Allen's safety after the sheriff said his jail couldn't protect him, and the confessions that matter were lucid.

We start with the April 14, 2023 psychiatric finding and the forced Haldol, along with the 30-day rule for seriously mentally ill inmates and the state's argument that it never applied. Then Brad Holder, the never-charged man whose hand rune the defense says matches the sticks on Abby Williams, against the landfill time card the state relies on. The last stretch is the unfired cartridge, the excluded metallurgist, the second police sketch Betsy Blair helped draw that the jury never saw, and the search warrant fight the state says Allen's own 2017 statement settles.

Bob walks through each legal test the judges will apply, including harmless error, which is how a court leaves a conviction standing even after finding a mistake.

Allen is serving 130 years for killing Abby Williams and Libby German. The panel has not ruled, and either side can seek review at the Indiana Supreme Court afterward.
