Mega Edition: The Supreme Court And It's Decision About Richard Allen's Lawyers (10/10/26)

In January 2024, the Indiana Supreme Court reinstated Richard Allen’s original court-appointed defense attorneys, Andrew Baldwin and Brad Rozzi, after Special Judge Fran Gull had removed them from the Delphi murders case months earlier. Gull had concluded that serious concerns about the attorneys’ handling of the case, including the unauthorized dissemination of sensitive crime-scene material from Baldwin’s office, justified taking them off Allen’s defense. Allen objected and took the extraordinary step of asking the state’s highest court to intervene. The Supreme Court agreed with him on that issue, ruling that removing a defendant’s chosen court-appointed lawyers over his objection required a much more careful showing that disqualification was truly necessary. The justices said Gull had not sufficiently weighed the prejudice to Allen or demonstrated that removing Baldwin and Rozzi was a last resor

The ruling did not give Allen everything he wanted. The Supreme Court refused his request to remove Gull from the case, finding that Allen had not overcome the legal presumption that she could remain impartial, and it also rejected his demand that his trial begin within 70 days because that request had not first been properly presented to the trial court. But the representation ruling was significant because it returned Baldwin and Rozzi to the defense team and established that a trial judge could not simply disqualify appointed counsel without carefully considering the defendant’s constitutional interests and less drastic alternatives. The decision effectively reversed one of the most controversial developments in the pretrial proceedings and allowed Allen to continue toward trial with the lawyers he had repeatedly said he wanted representing him.
