Indiana Supreme Court Hears Arguments on Reinstating Original Defense Team for Delphi Murder Suspect

Indiana Supreme Court Hears Arguments on Reinstating Original Defense Team for Delphi Murder Suspect

The Indiana Supreme Court was the stage for legal arguments on Thursday as Richard Allen, the individual charged with the 2017 double murders of teenagers Abby Williams and Libby German in Delphi, Indiana, seeks to reinstate his original defense team. Allen was notably absent from the court hearing, despite being the one who initiated the motion.

Originally scheduled to stand trial for the double murders this month, Allen's case took an unexpected turn last October. Special Judge Fran Gull dismissed Allen's public defenders, Bradley Rozzi and Andrew Baldwin, following a leak of crime scene evidence online. Judge Gull characterized the attorneys as "grossly negligent" as part of her rationale for their removal.

It later came to light that an employee of Baldwin and Rozzi's law office had taken the photos without permission, and they were not leaked by the lawyers themselves. Subsequently, new attorneys were assigned to Allen's case, with Judge Gull stating that his best interests required him to have access to a competent defense team.

During Thursday's proceedings, Mark Leeman, counsel for the relator, argued that Judge Gull had not conducted a formal hearing to voice her concerns about alleged negligence and incompetence; instead, she made the decision without a proper discussion. Chief Justice Loretta Rush acknowledged this oversight and wondered if Judge Gull had acted beyond her authority.

However, Matt Gutwein, counsel for the respondent, contended that the judge had indeed given Allen's former lawyers the option to continue with a trial, but they had voluntarily stepped down. Chief Justice Rush questioned the transcript from the conversation between Judge Gull and the attorneys, expressing doubts about whether the lawyers were genuinely given a choice regarding the trial.

In response to the situation, Richard Allen has made three requests to the Indiana Supreme Court: the reinstatement of Bradley Rozzi and Andrew Baldwin, the appointment of a new judge, and a trial to be held within 70 days.

Legal experts have offered differing perspectives on the potential outcome. Dr. Jody Madeira, a law professor at Indiana University, suggested that the judge would likely not be disqualified from the case, and Allen's original counsel might not be reinstated. She anticipated that the trial would move forward with a new defense team under Judge Gull's supervision.

However, criminal defense attorney Brian Clayton raised the possibility that the Indiana Supreme Court could allow Allen's original defense team to be reinstated. Clayton emphasized Allen's constitutional right to competent legal counsel and the familiarity of his original lawyers with the intricacies of the case. Allen has expressed his desire for Bradley Rozzi and Andrew Baldwin to represent him.

As a result of these legal proceedings, Richard Allen's trial, originally set for this month, has been postponed until October 2024. This delay is intended to provide Allen's new attorneys with sufficient time to review the case thoroughly.

Did Richard Allen Get A Fair Delphi Trial?

Did Richard Allen Get A Fair Delphi Trial?

Did Richard Allen Get A Fair Delphi Trial? Was Richard Allen simply the unluckiest man alive, or is there more to the tangled web of suspects in the Delphi case? As the appeal process begins, new details emerge that cast doubt on the original investigation. A 2017 confession from Ron Logan, another alleged suspect, describes chilling specifics about the crime, including the use of a box cutter—details that align eerily with the medical examiner's findings. So why were these claims sidelined, and how might this oversight impact the case against Allen? Jennifer Coffindaffer, retired FBI Special Agent, dives into the confounding decisions made in court, questioning whether the pursuit of justice was overshadowed by a need for closure. Could alternative suspects like Logan or Keegan Kline, who allegedly communicated with one of the victims before the crime, hold the answers? And with such critical evidence left out, did the jury ever have a fair shot at the truth? Is this a case of judicial missteps, or is there something far darker at play? #DelphiMurders #TrueCrime #RichardAllen #RonLogan #KeeganKline #JusticeForAbbyAndLibby #HiddenKillers Want to listen to ALL of our podcasts AD-FREE? Delphi Murders: Defense Files Motion Citing Critical Legal Errors in Richard Allen Case

Delphi Murders: Defense Files Motion Citing Critical Legal Errors in Richard Allen Case

Attorneys for Richard Allen, convicted of the 2017 murders of Liberty German and Abigail Williams in Delphi, Indiana, have filed a Motion to Correct Errors. The motion highlights four alleged legal missteps that they argue are significant enough to overturn the jury’s verdict or warrant a new hearing. Allen was convicted in November 2023 and sentenced the following month to 130 years in prison for the February 13, 2017, murders of the two teenage girls. The case has drawn nationwide attention for its complexity and lengthy investigation. The motion, filed by defense attorneys Andrew Baldwin, Jennifer Auger, and Bradley Rozzi, represents the first formal step toward appealing Allen’s conviction. The defense raises concerns about the legality of Allen’s custody transfer, which occurred after his arrest. They allege the transfer from the Carroll County Jail to the Indiana Department of Corrections was conducted unlawfully, as Allen’s attorney was not notified, denying him the right to legal representation. “Mr. Allen was not afforded either the right to be heard by counsel or by himself at the safekeeping ‘proceeding,’” the motion states. The motion also claims prosecutors failed to correct false testimony concerning a white van seen in the area on the day of the murders. Surveillance footage presented by the defense contradicts the timeline provided by the prosecution, potentially impacting the jury's decision. “When the State introduces testimony it knows will be false or fails to correct testimony it knows or should know to be false, once elicited, a conviction must be vacated or reversed if that false evidence ‘may have had an effect on the outcome of the trial,’” the defense argued. A third issue raised involves a reported confession by another individual in 2017. Notes from an inmate claim that another person confessed to the murders, allegedly mentioning the use of a boxcutter. This claim is significant, given changes in testimony about the murder weapon during Allen’s trial. The defense contends this confession could have established probable cause for an alternative suspect, further undermining the state’s case. Additionally, questions surrounding the forensic analysis of Liberty German’s cellphone have been brought to light. The defense challenges the state’s claims that environmental factors, such as water or dirt, could have caused data suggesting headphones were plugged into the phone at the crime scene. “Ms. Eldridge’s opinion that dirt or water could not have caused L.G.’s phone to log wired headphones being plugged into and being unplugged from the phone on February 13, 2017, exculpates Mr. Allen and would probably produce a different result at a new trial,” the motion argues. The defense seeks either a dismissal of Allen’s convictions or a hearing to address the errors detailed in the motion. This filing is separate from the formal appeal anticipated to be submitted by newly-appointed appellate attorneys for Allen. The court’s response to the motion will determine the next steps in the legal proceedings and the future of Allen’s conviction. #DelphiMurders #TrueCrime #RichardAllenCase #LegalErrors #JusticeForLibbyAndAbby #AppealProcess #CriminalJustice Want to listen to ALL of our podcasts AD-FREE?
