Did Caleb Flynn Tell His Mistress He Was About To Kill?

Prosecutors say Caleb Flynn typed the date his wife would die into a message to his mistress the night before it happened. That text opened the Caleb Flynn trial in Miami County, Ohio, and this episode walks through opening statements and the first two days of testimony in the American Idol murder case. Prosecutor Paul Watkins read three messages to the jury. Two were sent months before Ashley Flynn's death, one about killing her without going to jail, one about doing it in a heartbeat if it didn't mean hell. The third named February 16. Defense attorney Emily Smith conceded the affair and the messages in her opening, called them ugly things Caleb said to appease his mistress, and argued police reached a conclusion first and fit the evidence to it. The state's crime scene agent testified the garage door Caleb blamed on an intruder had damage on the inside only, that the damage happened with the door open, and that both locks were unlocked with a refrigerator against the door. A police dog tried three times to go back into the house and found no trail leaving. The deputy coroner described two parallel close-range wounds behind Ashley's ear while she lay sleeping. Caleb's alibi is that he was in his daughters' room; the agent said the bottom bunk was so full of stuffed animals he didn't think two people could sleep in it. Both daughters are on the witness list. The judge denied a screen because the state offered no evidence these children needed one, so they'll testify with their father in the room. Caleb Flynn has pleaded not guilty to aggravated murder, murder, felonious assault and tampering with evidence. The device data prosecutors promised, his Apple Watch and phone activity in the hours around Ashley's death, hasn't been shown. Neither have the girls.
