Even Caleb Flynn's 12-Year-Old Saw It Coming

Jill Smith's phone rang at 3 a.m. on February 16. It was her son-in-law, Caleb Flynn, telling her someone had broken in and shot Ashley. On the third day of the Caleb Flynn trial in Miami County, Ohio, Jill told the jury what happened next, and by the end of the day her granddaughter's three-word reaction to the affair was in the record.

Jill testified she got dizzy and lay on the bathroom floor before she could drive. Body camera footage from earlier in the trial showed Caleb on his knees on the lawn when she arrived, telling her the girls were still sleeping and that he didn't know what to do. She said he then gave her the account he later repeated to her daughter Kayla and her husband Todd: a cough, the couch, a dog's collar, lying down with the younger girl, a gunshot. The defense asked Jill no questions.

Todd Smith testified he brought Caleb into the family company, paid him well, and mailed monthly checks from the inheritance, and that on the drive home from Quebec he couldn't understand why the dogs never barked. Jill had told him not to go there. Kayla Keyt said she believed police had the wrong man until the FBI told her about the other woman, who worked in the music ministry at the family's church.

A Tipp City police captain showed the jury bank records including a monthly Snoopreport charge, a service that tracks another person's Instagram, running from September through January. Ohio BCI scientists found no foreign DNA in the house. The defense established that Caleb volunteered his DNA and prints, was never tested for gunshot residue, and that no print or DNA can be dated.
